Terms of Service
1. The service
Book the Captain ("we", "us") provides website, booking, payment-facilitation, and communication software for charter operators ("you", the "Captain"). We are a software provider. We are not a party to any charter, trip, or transaction between you and your customers, and we are not a marketplace, agent, or merchant of record for your sales.
2. Your account
You are responsible for the accuracy of the information on your site, for maintaining the confidentiality of your credentials, and for all activity under your account. You must hold all licenses, insurance, and permits required to operate your charter business, including any applicable USCG credentials.
3. Payments
Card payments are processed through your own Stripe account via Stripe Connect. You are the merchant of record: refunds, chargebacks, and disputes are between you, your customer, and Stripe. Plans may include a platform fee on payments processed through the service, and subscription or usage-based charges as described on the pricing page. Fees are billed via Stripe invoicing and are due within the stated terms.
4. Billing
"Booked month" billing applies to calendar months containing at least one confirmed trip. Annual plans renew each coverage year until cancelled. You may change or cancel plans at any time from your dashboard; charges already incurred are not refunded except where required by law.
5. Your content and your customers
You retain all rights to your content, your customer list, and your business data. You grant us the limited license needed to host and display that content in order to operate the service. You are responsible for your waiver text, policies, and compliance with laws that apply to your business, including messaging-consent rules for email and SMS sent to your customers.
6. Acceptable use
No unlawful use, no infringing or deceptive content, no attempts to breach or overload the service, and no use of the platform to send spam. We may suspend accounts that put the service or other captains at risk, with notice where practical.
7. Availability and support
We aim for high availability but the service is provided "as is" and "as available", without warranties of any kind. Scheduled maintenance and factors outside our control (including third-party providers such as Stripe, SMS carriers, and DNS) may affect availability.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of the service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages, or for anything that happens on or around your vessel.
9. Termination
You can close your account at any time. On closure we make your data available for export for a reasonable period before deletion. We may terminate for material breach of these terms.
10. Changes
We may update these terms; material changes will be announced to the account email with reasonable notice. Continued use after the effective date constitutes acceptance.
